WELLNEST TERMS OF SERVICE (UK)

Welcome to WellNest. By accessing or using our services, you agree to be bound by the following terms and conditions ("Terms of Service"). Please read these Terms carefully before using our services.
1. Acceptance of Terms
By signing up for membership, using our facilities, or accessing our website and app, you agree to comply with and be legally bound by these Terms of Service. If you do not agree to these terms, you should not use our services. These Terms are provided in accordance with UK law.
2. Membership and Access
2.1 Membership Eligibility
Membership is available to individuals aged 18 years or older. Minors (under 18) may only access our services with explicit parental or guardian consent.
Memberships are non-transferable and non-refundable, except as provided under UK consumer law.
2.2 Types of Memberships
We offer different membership options including Full Access, Spa-Only, Class-Only, Day Pass, and Founding Membership. The specific benefits of each membership are described on our website and app.
2.3 Membership Payment
All membership fees are billed monthly unless otherwise stated. By joining WellNest, you authorise us to charge your chosen payment method automatically for recurring membership fees.
Membership payments are managed via a third-party provider in compliance with PCI DSS security standards.
WellNest reserves the right to suspend or terminate your membership if payment is overdue.
2.4 Cancellation and Refunds (UK Consumer Rights)
You have the right to cancel your membership within 14 days of signing up, in accordance with UK Consumer Contracts Regulations 2013, and receive a full refund if no services have been used.
After this 14-day period, you may cancel your membership at any time, but no refund will be provided for any unused portion of the current month.
Cancellations must be made through the WellNest app or by contacting customer service at least 7 days before the next billing cycle to avoid charges for the following month.
3. Use of Facilities
3.1 Code of Conduct
We aim to provide a safe, inclusive, and respectful environment at WellNest. By using our facilities, you agree to:
Respect other members and staff.
Use equipment responsibly and safely.
Follow the guidance of WellNest staff, including any specific health and safety instructions.
Comply with all posted rules and notices at the facility.
Any breach of this code of conduct may result in suspension or termination of your membership.
3.2 Booking and Use of Facilities
Members must book classes, spa sessions, and other services through the WellNest app or website.
WellNest reserves the right to modify class schedules, availability of spa services, and events as needed.
Members are responsible for their belongings. WellNest is not liable for loss, theft, or damage to personal items unless caused by negligence on our part.
3.3 Health and Safety
By using our facilities, you declare that you are physically fit and capable of participating in your chosen activities.
If you have any medical conditions or injuries, please consult your doctor before engaging in any physical activities at WellNest.
If you feel unwell or experience any discomfort during a session, you must stop immediately and inform a member of staff.
3.4 Facilities Maintenance
From time to time, certain areas of WellNest may be closed for maintenance or refurbishment. We will give you as much notice as possible and will aim to minimise disruption to your experience.
4. Classes, Spa Sessions, and Cancellations
4.1 Class and Session Bookings
Classes and spa sessions must be booked in advance via the WellNest app or website. Availability is on a first-come, first-served basis.
Members are allowed to book a maximum of 5 classes or sessions per week in advance.
4.2 Cancellations
You may cancel a booking up to 24 hours before the scheduled class or spa session without penalty.
Late cancellations or no-shows may incur a fee or the loss of a session from your membership allowance.
5. Café and Retail
The WellNest café offers healthy snacks, smoothies, and beverages. Café purchases are not included in memberships unless otherwise stated.
All retail items (e.g., merchandise) purchased from WellNest are subject to the Consumer Rights Act 2015. If goods are found to be faulty or not as described, you are entitled to a refund, repair, or replacement within 30 days of purchase.
6. Privacy and Data Protection (GDPR)
6.1 Collection of Information
WellNest collects personal information including your name, contact details, payment information, and health-related data to manage your membership and provide our services. By using WellNest, you consent to our collection and use of your data in accordance with the UK General Data Protection Regulation (GDPR) and our Privacy Policy.
6.2 Data Security
We take appropriate technical and organisational measures to protect your personal data.
All payment information is processed securely through third-party payment providers and is never stored on WellNest systems.
6.3 Third-Party Services
Some services (such as payment processing) may be provided by third-party companies. WellNest is not responsible for the privacy practices of these third-party services. You should review their privacy policies when using their services.
6.4 Your Rights

7. Limitation of Liability
WellNest is not responsible for any injury, illness, or loss incurred as a result of using our services unless caused by negligence or breach of duty on our part.
You agree to assume full responsibility for your actions during participation in activities at WellNest.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under UK law.
8. Modifications to Terms
WellNest reserves the right to modify these Terms of Service at any time. We will notify you of any significant changes via email or app notification. Your continued use of WellNest services after changes are made constitutes your acceptance of the updated Terms.
9. Termination of Service
WellNest reserves the right to suspend or terminate your membership if you violate these Terms or engage in conduct harmful to the WellNest community or staff.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of WellNest services will be subject to the exclusive jurisdiction of the courts of England and Wales.
